We are UPSC civil service aspirants from all over the country who seeks compensatory attempt in 2021

Subject: Seeking justice for last attempters for UPSC civil service examination who were disproportionately affected by COVID-19 pandemic.

Issue:
1. Center denied extra attempt to all age barred people based on dubious arguments.
2. Center promised before the exam to consider last attempters an extra attempt, however, denied to do so at last moment.
3. SC has given its judgment based on the illogical arguments and wrong facts.


Why last attempt aspirants are requesting for an extra attempt?
During COVID-19 -pandemic almost all the aspirants are affected equally, However, below age limit candidates have hope left as they can retake the exam next year. The, last attempters of 2020 who also equally took the burn of the pandemic have no recourse whatsoever and were hence left with no hope land were written off as an unlucky batch. Few instances of how the aspirants are affected are given below.
1. Many aspirants were COVID effected and could not appeared for the exam.
2. Aspirants who were taking care of their affected families could not appear for the exam.
3. Aspirants who were COVID warriors such as doctors, nurses who were on national duty were denied holiday to prepare or appear for examination.
4. Covid affected aspirants were straightway denied to appear for the exam by UPSC itself when they enquired about any special provisions arranged to them
5.Body temperature was checked before entering exam and denied entry into examination hall even for normal fever.
6. Aspirants are stuck in containment zones and quarantines and are unable to write the exam.
7. Restrictions on travel by few states.
8. Many candidates were afraid that they may infect their aged family members after attending the exam being exposing to the crowd at the examination center.
9. Centre mislead the candidates by suggesting to the Supreme Court that last attempters will be considered for an extra attempt before the exam itself.
10. Many Aspirants had to take up family economic activities to save their aged ones instead of studying.

History of the case. Feb 12 : Preliminary Examination was scheduled on 31.05.2020.
June 1-30: Unlock 1.0 was effected inter-alia, Inter-state travel was allowed.
June 5: Exam was rescheduled to October 4th 2020
July 1-31:Unlock 2.0 was effected.
July 01: Notice for the candidates to submit revised choice was issued.
August 1-31: Guidelines for Unlock 3.0 were issued by the MHA.
September 1-30: Guidelines for Unlock 4.0 were issued. Academic gatherings only up to 100 people were allowed before October 15.
September 28: case was filed before supreme court to reschedule the prelims examination (First hearing) or combine 2020 with 2021.
Sept 30: center denied saying there will be cascading effect, how ever agreed, to consider extra attempt for last attempters.
Sept 30 to October 23: no decision was made regarding extra attempt.
October 23: results announced.
October end: Plea was filed in SC regarding regarding extra attempt and awaited decision
November: Center said no adversial stand would be taken against last attempters.
Sept 30 to jan 25: no decision was still taken regarding the extra attempt.
Jan 25: Center said no extra attempt will be provided for any one.
Feb 5: age relaxation was agreed in principle for only to non age barred aspirants.
Feb : SC denied extra attempt for all.

Centers arguments: 1. Petitions were filed after the results are announced.
2. Exam portion was not changed and exam postponing gave extra time to prepare and 8 months is enough to prepare for the exam.
3. Entry age is 21 giving 11 years to prepare for the exam.
4.. Unlock guidelines 5.0 are in force October 2020.
5. Candidates who appeared have accepted rules of examination.
6. Examination was not held during lock down.
7. It would create a cascading effect on other examinations.
